I.1 The main purpose of the Pattern Design library for weaving companies is to enable weavers to expand their offer for clients and prospects. Furthermore, its goal is to reduce the inevitable costs that come with creating numerous samples, which are often required to acquire production orders from new or existing customers.
I.2 In order to be eligible for using the library for sampling purposes (see section IV), the user must have signed up as a weaving company using the special signup form for weaving companies on patterndesigns.com.
I.3 The users account on patterndesigns.com must be active.
I.4 The user general terms and conditions of patterndesigns.com are in effect.
II.1 In order for the user to be granted the rights of utilization, as stated in section III., the user has to be actively subscribed.
II.2 A subscription shall be considered active if the subscription fee for the current subscription period was paid and the user has an active user account with Pattern Design.
II.3 A subscription period lasts a full month.
II.4 If the subscription was not cancelled by the user at the end of the current subscription period, the subscription will be automatically extended for another month.
II.5 The costs for the subscription, in form of a monthly subscription fee, will be invoiced at the beginning of each new subscription period.
II.6 The subscription can be cancelled by the user at any time.
II.7 Pattern Design does, however, not grant a refund for any subscription fees that have already been paid.
III.1 Pattern Design grants the following rights of utilization to the user as long as he is subscribed and his subscription is active (see section II.2):
III.1.a The right to download the pattern library for weavers at any time from within his user account on patterndesigns.com
III.1.b The right to download all available update packages, which contain new designs
III.1.c The right to use all patterns from the library for presentation and sampling purposes (see section III.2). The patterns from this library may be used free of charge, without limitations as to the number of weaving runs, the number of samples produced or the size of the produced samples.
III.2 The rights of utilization, as stated in III.1.a – III.1.c, only apply for presentation and sampling purposes, as described in section IV.1.
III.3 For production use (defined in section IV.2.), the user has to buy a „Vector Unlimited“ license from patterndesigns.com. This license has to be bought for every design that will be utilized for any production run.
IV.1 The purpose of the usage of a design from the library is defined as „sampling purpose“, whenever the user creates (weaves) a sample in order to
IV.1.a test the process of weaving the given design and to check the output (=sample fabric), or
IV.1.b use the sample for presentation, with the main purpose of acquiring new customers or orders
IV.2 The purpose of the usage of a design from the library is defined as „production purpose“, whenever:
IV.2.a the physical ownership of the produced material changes, or
IV.2.b the production or the production output will be invoiced by the user, or
IV.2.c the purpose of the production is to produce on stock for later sale
V.1 Pattern Design reserves the right to terminate this contract, as well as the users subscription, at any time, without the necessity of providing a reason for doing so.
V.2 If the user violates any part of this contract, Pattern Design reserves the right to terminate this contract and take the necessary legal action against the user.
V.3 Upon termination of this contract or termination of the users subscription, any utilization rights granted in section III. lapse with immediate effect. The user is required to delete all files he received for sampling purposes, as well as all files which were created by modifying any one of the designs from the library. Excluded from this required action are all files that were created using a design for which the user bought a „Vector unlimited“ license (see V.4)
V.4 The termination of this contract has no effect on the licenses and usage rights a user acquires from buying a license on patterndesigns.com.
